The Labour Court allowed Sudath Thelge Peiris’s appeal and said The Lakes Restaurant & Takeaway Limited should pay him €640.80 for breaches involving annual leave, public holidays and entitlements at the end of employment. The determination was signed on 21 October 2015. Peiris worked for the restaurant from 2 May to 3 July 2014 and said he had not received those entitlements. The Rights Commissioner’s decision had found that his complaint should fail for want of prosecution. The employer did not attend the Labour Court hearing. Based on Peiris’s uncontested evidence, the Court found breaches of sections 20, 21 and 23 of the Organisation of Working Time Act, 1997.
