The Labour Court allowed Tomas Valent’s appeal against Viking Security Limited and directed the company to pay a Sunday premium of time-plus-one-third for each Sunday hour worked, plus arrears for Sundays worked in the six months before his claim. The determination was signed on 15 October 2014.
Valent said his engagement letter stated his hourly rate but did not explain that it included Sunday compensation. Viking Security argued its €10 rate already incorporated a premium. The Court found the Sunday element had not been clearly identified in the contract or explained when his employment began, and the company had not shown the rate included reasonable compensation. It substituted its determination for the Rights Commissioner’s decision.
