The Labour Court upheld a €1,000 award to Jose Cano Ruiz against Prime Steak Limited Trading As Rustic Stone. The determination was signed on 28 October 2014 after the employer appealed the Rights Commissioner's decision. Ruiz said he worked an average of 65 hours a week, missed weekend breaks and had not received annual leave pay when his employment ended. The employer disputed his account and said it had paid €280 for outstanding annual leave. The Court found the employer had not kept adequate records or provided sufficient evidence to support its account. It upheld complaints under sections 11, 12 and 23 of the Organisation of Working Time Act 1997, but did not uphold the section 15 complaint because it could not be assessed over a four-month reference period. The €1,000 award was payable within six weeks.
