The Labour Court allowed Yulianna Brekhlichuk’s appeal over Sunday work and awarded her €400 compensation. In a determination dated 29 July 2014, the Court varied the Rights Commissioner’s decision, finding that Ireland's Eye Seafoods Ltd, trading as Wrights of Howth, had breached the Organisation of Working Time Act 1997. Brekhlichuk said her €9.50 hourly rate did not include a Sunday premium. The employer argued that the rate reasonably included one, noting that the retail rate it cited was €8.65 an hour. The Court found Sunday work had not otherwise been taken into account in her pay and that she had not received a reasonable allowance. The appeal concerned the Sunday-premium issue only.
