The Labour Court kept Roksana Wypych’s €5,000 compensation award after varying the Rights Commissioner’s decision on Pagewell Concessions (Ilac) Ltd T/A Euro 50 Stores’ appeal. The determination was signed on 23 May 2014. Wypych had worked as a trainee store manager at the company’s Dublin store.

The Court found that the company breached working-time rules on daily rest, Sunday premium and notice of starting and finishing times. It found the complaints about rest breaks and the additional working-time provision not well founded; neither was pursued at the appeal hearing. Wypych’s counsel said the section 15 complaint was not being pursued because it had been accepted at first instance that there was no contravention. The Court varied the earlier decision to reflect its findings but left the €5,000 compensation unchanged.
