The Labour Court rejected Kevin Blake T/A Spar’s appeal and ordered the respondent to pay Jaroslaw Homa €250 for an annual leave pay infringement. The determination was signed on 16 May 2014; the Rights Commissioner had awarded €200. Homa worked as a shop assistant from 15 June 2007 to 19 May 2013 and received a weekly holiday premium of 8% for all hours worked. The Court found annual leave pay had to be paid in advance of leave and that the more-favourable-arrangements provision did not permit inferior arrangements.
