Labour Court dismisses Wroblewicz appeal over annual leave jurisdiction

The Labour Court dismissed Wojciech Wroblewicz’s appeal for lack of jurisdiction in a determination dated 7 May 2014. The merits were not decided. Wroblewicz argued that he was entitled to accrue annual leave while absent from work due to an injury. Murray Timber (Ballon), trading as Murray Timber Group, said the issue had not been raised before the Rights Commissioner. The Court found the appeal raised a claim different in substance from the one decided at first instance, so it could not determine the new question.
