The Labour Court partly allowed Volodymyr Zamulinskyy’s appeal against Broadford Cleaning & Maintenance Services Ltd T/A Direct Cleaning Services, raising compensation for daily rest and maximum weekly-hours breaches to €1,000 each. It left the €400 breaks award and €200 Sunday-premium award unchanged, and affirmed dismissal of his section 18 claim. The determination was signed on 6 May 2014. Zamulinskyy argued that section 18 applied after work ceased during industrial action and until he formally resigned. The Court found the provision could not apply to the circumstances and affirmed dismissal of that claim. It increased the section 11 and section 15 awards because those breaches were continuing and the original compensation was inadequate. The respondent did not attend the hearing, but the Court was satisfied it had been notified.
