The Labour Court awarded Manoj Kumar €1,250 after finding T&S Ethnic Restaurant Ltd T/A New Maharajah breached annual leave rules. It dated its determination 8 April 2014. Kumar appealed a Rights Commissioner decision, arguing that the restaurant had breached working-time rules. The employer said he managed his own hours and fell outside the Act; the Court found it set his hours, so the Act applied. The Court also upheld complaints about daily rest, Sunday premium and the 48-hour weekly limit, awarding €200, €100 and €300 respectively. It rejected complaints about breaks and weekly rest, finding Kumar took breaks and had not shown he was required to work seven days in the relevant period. No public holiday fell in that period. The Court said the appeal was not upheld.
