The Labour Court awarded Sarah Mullen €3,000 after finding Ticketline Trading As Ticketmaster infringed working-time rules. The determination was signed on 10 April 2014.
Mullen said she had to remain available for shifts without guaranteed work, while Ticketline disputed that she was required to do so. The Court relied on her uncontradicted evidence and found her contract had been administered as though she had to be available whenever the company required. It ruled she was entitled to at least 25 per cent of the relevant hours, calculated by reference to work done by another employee.
The Rights Commissioner had dismissed her claim for lack of prosecution after she did not attend a hearing. Mullen appealed, and the Labour Court decided the complaint on its merits.
