The Labour Court reduced Darius Zakas’s compensation from €300 to €100 after The Goode Life Food Company appealed a decision over delayed cessor pay. The Court found the Organisation of Working Time Act had been contravened and varied the award in a determination dated 14 March 2014.
The Rights Commissioner had found that Zakas received the money due, but only after a delay, and awarded €300. The company said its accountant had been instructed to make the payment but failed to do so.
Zakas did not attend the appeal hearing, although he had been notified. The Court said he must have suffered some inconvenience from the late payment, but had not presented an argument for keeping the original award. It nevertheless found a breach and reduced the compensation to €100.
