The Labour Court awarded Cristian Zamfir €2,000 after finding that Lorien Enterprises Limited T/A Cafe Topohs and Zaytoon breached working-time rules on breaks, public holidays and annual leave. In a determination dated 13 March 2014, the Court varied the Rights Commissioner’s decision on Zamfir’s appeal.
Zamfir said he worked long days without breaks, was not paid for two public holidays and was owed a week of annual leave. The employer disputed his claims and said he had received his entitlements and worked no more than 36 hours a week. The Court found the employer had not kept required records and considered its payslips of limited value. It found no breach of the rule on weekly working hours. The award comprised €1,300 for the breaks breach, €130 for public holidays, €325 for accrued leave and €245 in general compensation.
