The Labour Court overturned the Rights Commissioner’s decision and allowed Muhammad Fahim’s holiday-pay appeal, directing Robert Murphy T/A Nan's Supervalu Ballymun to pay €735. The determination was dated 24 February 2014.
The Rights Commissioner had found Fahim’s claim failed for lack of prosecution after he did not attend the hearing. Fahim appealed, saying he had moved address and did not know the hearing date. At the Labour Court hearing, the employer accepted that €735 was owed for outstanding annual leave. The Court directed payment within six weeks.
