The Labour Court allowed Jacek Majchrzak’s appeal against DMR Transport Limited and varied a Rights Commissioner’s €2,000 award in a determination signed on 14 February 2014. It awarded him €500 for inadequate rest between shifts, €1,500 for breaks that were not ensured, €1,500 for regularly working more than 48 hours a week and €80 for public holiday underpayment.
Majchrzak said he had not received statutory breaks and rest periods and was underpaid for annual leave and public holidays. DMR Transport Limited said breaks were his responsibility, that his pay was correct and that his finishing times varied because the job was task and finish. The Court rejected his complaints about advance notice of finishing times and annual leave: the workload determined when he finished, and payment for untaken leave was properly calculated. It also found that the company had not kept required working-time records.
