The Labour Court increased Irena Kalcuka’s annual leave compensation to €2,500 on her appeal against Broadford Cleaning & Maintenance Services Ltd T/A Direct Cleaning Services. The determination was dated 21 November 2014.
Kalcuka said the original €1,200 award did not include enough general compensation. The Rights Commissioner had found that the employer failed to provide paid annual leave and awarded €1,200, which the Labour Court considered reflected the economic value of the leave withheld. The Court said that amount was insufficient redress and that compensation should also deter further breaches. It allowed the appeal and substituted an award of €2,500. The employer did not attend the hearing.
