The Labour Court affirmed a Rights Commissioner’s finding that Jelena Golubova’s complaint against Tempside Limited was not well founded and did not allow her appeal. The complaint alleged that Tempside penalised her by not assigning her work after she submitted a medical certificate. The Court found that Golubova had not provided a certificate showing she was fit for her post’s duties or clarified which duties she could perform. It found that it was reasonable for Tempside to delay her return until her medical capacity was clarified. The Court said an alleged incident on 3 November 2012 was not a material factor in its consideration.
