The Labour Court extended Rasa Melniciukiene’s time to bring her public-holiday pay claim and directed Weststar Hotel Ltd T/A The Westgrove Hotel & Conference Centre to pay her a day’s pay for 14 holidays, plus €1,000 in compensation. The determination was dated 22 May 2013.
Melniciukiene had asked the hotel about her holiday entitlements and was assured she was receiving them. The hotel accepted it had underpaid her and that she had received those assurances. The Court found the assurances explained and justified her delay, extending the time limit to 25 February 2011. Each day’s pay is to be calculated by reference to her normal daily hours before the relevant holiday.
