The Labour Court allowed Ballinalard Transport Limited’s appeal, set aside the Rights Commissioner’s decision and made three separate awards of €1,500 to driver Zolton Gonczi. It found three working-time complaints well founded and the weekly-hours complaint not well founded. The determination was signed on 15 May 2013. The Court found Gonczi was denied proper breaks after work while queuing was recorded as rest, and that the company had not shown Sunday work was reflected in his pay. It also found the company had not shown that his public-holiday entitlements were provided. The weekly-hours complaint failed after Gonczi said his hours from January to June 2009 complied with the law.
Labour Court keeps three €1,500 awards but rejects weekly-hours complaint
