The Labour Court upheld three working-time complaints by driver David Fenlon against Ballinalard Transport Ltd and ordered €2,000 compensation for each. The determination was signed on 15 May 2013. The Court found the company had not shown that Sunday work was reflected in Fenlon’s pay. It also found six days of annual leave remained unpaid and could not be offset against a debt for damage to a company vehicle. The Court further found he was entitled to payment for the October 2009 public holiday and for Christmas Day and St Stephen’s Day that year.
