Labour Court sets aside working-time decision on time-limit grounds

The Labour Court set aside a Rights Commissioner’s decision on Antonin Barvir’s working-time complaints against Ballinalard Transport Ltd, finding it had no jurisdiction to investigate them. The determination was signed on 30 April 2013; the merits were not decided. Barvir had left the job on 10 October 2011 and complained on 24 April 2012. The Court found that because he had not worked for the company in the six months before making the complaint, the alleged infringements could not have occurred within the statutory time limit.
