The Labour Court increased Tomasz Szarlata's compensation for unpaid annual leave and public holidays from €475 to €550 on his appeal. The determination was dated 18 April 2013. Szarlata, a spray painter, worked in Paul Clarke's body repair shop until he was made redundant in June 2012. Clarke accepted the Rights Commissioner's decision and said the shortfall arose during a severe decline in business. The Court found that the original award reflected only Szarlata's actual loss and that Clarke had not taken all reasonable steps to address the breach. It allowed the appeal, found the complaint well founded and ordered Mr Clarke to pay €550, varying the Rights Commissioner's decision.
