The Labour Court upheld Paul Kelly’s appeal against a Rights Commissioner decision and awarded him €2,250 for infringements of his annual leave entitlement. The determination was signed on 15 February 2013. Kelly said he had not received all the leave due for the leave years beginning in April 2010 and April 2011. The employer, Michael McNally Trading As the Calendar Company, did not attend the hearing or provide records showing it had complied with the law. The Court found it had failed to prove compliance and set aside the earlier decision in the employer’s favour.
