The Labour Court set aside a €500 award to Dominika Zajmalowska after allowing the appeal by O’Flaherty’s (Nassau Street) Limited trading as Reads Print, Design & Photocopying Bureau. The determination was signed on 16 April 2013. The award concerned a claim that Ms Zajmalowska missed statutory breaks during the 2011 Christmas period. She withdrew the claim by letter dated 8 May 2012, and the Labour Relations Commission confirmed the withdrawal on 1 June 2012. The Court found that the claim had been withdrawn and that the Rights Commissioner had no jurisdiction to deal with it.
