The Labour Court overturned a Rights Commissioner’s decision and awarded Martin O' Connor €1,500 after finding Eupreia Ltd T/A Dingle Skellig Hotel & Peninsula Spa breached his working-time rights. Its determination was dated 11 November 2013. O' Connor appealed after his meal-break claim was dismissed when he did not attend the Rights Commissioner hearing. He said kitchen demands meant he missed breaks on several occasions. The hotel said staff were told of their entitlements and that he had not told management he was missing breaks. The Court found that breaks were generally taken after May 2012, but the records were unsatisfactory and there were no records for the earlier period from 10 March 2012. A separate claim about Sunday premium was withdrawn.
