Labour Court dismisses Mohamad Waseem’s appeal over Agita Laugale’s time extension

Place: no local area assigned from the source.

The Labour Court dismissed Mohamad Waseem’s appeal and upheld an extension of time for Agita Laugale to bring a Working Time complaint. The determination was dated 22 October 2013. The Court accepted evidence that Waseem had repeatedly assured Laugale he would pay the claimed amounts. After he said in late April or early May 2012 that he would not concede the claims, Laugale acted promptly, and the Court found no evidence that Waseem was prejudiced by the delay. It rejected her lack of knowledge of the time limit and concern about her husband’s legal status as explanations for the delay. The appeal concerned only the extension of time. The underlying Working Time complaint was not decided.
