The Labour Court disallowed Andrius Stasaitis’s appeal against Noonan Services Group Ltd over work breaks and affirmed the Rights Commissioner’s decision. The determination was signed on 6 September 2013. Stasaitis, a security guard, said he could not leave the security hut during his shifts and that Noonan had not set break times. Noonan said he could take breaks during inactive periods and had kitchen facilities in the hut. The Court found it probable he had been told he could take breaks during those periods and noted he had taken them. It found the break arrangements complied with the regulations and that an exemption from the statutory break requirements applied. The complaint was not well founded.
