The Labour Court overturned a €2,000 award to Anna Szkutnik after Clean Plus Ltd appealed, finding the company had paid her annual leave correctly. The determination was dated 27 June 2012.
Szkutnik, a cleaner, said her annual leave pay was based on a nine-hour week after her hours fell from 27 a week in October 2010. Clean Plus Ltd said it had met her contractual entitlements. The Court found her normal rate of pay did not vary and that she received the appropriate annual leave pay under the regulations. It allowed the employer’s appeal and set aside the Rights Commissioner’s decision awarding €2,000. Her section 17 complaint and public holiday claim under section 21 were withdrawn.
