The Labour Court upheld the €3,000 award to driver Deniss Vahterovs after dismissing his appeal to increase it. In its determination dated 26 January 2012, the Court upheld his complaints against Key Waste Management Limited over breaks, weekly hours and notice of overtime. The Court found pressure to complete daily work prevented Vahterovs from taking effective breaks and that he regularly worked more than 48 hours a week. He learned whether overtime was required only when his shift began. The company had not kept statutory records and did not prove it complied with the law. Key Waste Management said it had corrected its practices, and a company director accepted some workloads may have put pressure on drivers. Both sides agreed the situation had been addressed, and the Court found the original award appropriate.
