The Labour Court awarded Robertos Preiksaitis €1,088.48 for underpaid annual leave and public holiday pay, overturning a Rights Commissioner decision that dismissed his complaints for lack of prosecution. The determination was dated 11 April 2012. The Court found the Registered Employment Agreement for the construction industry applied, but that there was not enough evidence to classify Preiksaitis as a carpenter. It set his rate as a Construction Operative at €16.37 an hour, replacing the €11.45 hourly rate he had received. The Court found his annual leave pay was underpaid and awarded €826.56 for 21 days of leave. It also awarded €261.92 for eight hours of public holiday pay for May and June 2011. Comerford Developments (Ireland) Limited did not attend either hearing or make submissions.
