The Labour Court disallowed Edward Keogh’s appeal over annual-leave and public-holiday pay, affirming that he was not an employee of Michael Haugh Trading As Connect Couriers under the Organisation of Working Time Act 1997. The determination was signed on 3 April 2012. The Court found that Keogh’s delivery-based earnings and responsibility for his motorcycle’s costs were consistent with self-employment. As he was not employed under a contract of service, the Rights Commissioner lacked jurisdiction to examine the holiday-pay claim; the merits were not decided.
