Labour Court raises Wincanton worker’s award to €7,000

The Labour Court set aside a €900 award and increased compensation to €7,000 for Pawel Pioro after finding Wincanton Ireland Limited breached his working-time rights. The determination was dated 6 March 2012.

The Court found breaches involving daily and weekly rest, breaks and working hours. Pioro received only a 10-minute break during a five-and-a-half-hour work period, and Wincanton permitted him to work an average of 49.5 hours a week. The Court described the weekly-rest breaches as serious.

Two other complaints failed. The Court found no breach of public-holiday entitlements, as Pioro received the required pay for holidays worked and not worked. His overtime complaint was not well founded because he accepted overtime voluntarily and was not required to work it.
