Labour Court varies working-time decision and awards Rafal Burtan €1,500

The Labour Court varied a Rights Commissioner's decision and awarded Rafal Burtan €1,500 after finding breaches of working-time rules. The determination was signed on 16 January 2012. The Court found The Fleet Street Inn Dublin Ltd had not kept accurate records and therefore failed to prove compliance with break rules. It also found Burtan was not paid a Sunday premium, annual leave was paid without him being required to take it, and he was entitled to payment for the 25 December public holiday. The Court found his contract required Sunday work, so the Section 13(5) complaint was not well founded. His Section 17 complaint about notice of additional hours was also not well founded because he had not identified dates showing a breach within the relevant period.
