The Labour Court found that Circus Gerbola Limited breached six working-time provisions in its treatment of El Mostafa Chtabbou and awarded him €4,500. The determination was dated 27 December 2012, varying a Rights Commissioner’s €4,000 award. Chtabbou appealed the finding on his complaint about the 48-hour weekly limit; the company appealed the decision as a whole, including the extension of the time limit. The Court upheld the extension, citing Chtabbou’s limited English, isolation within the circus community, lack of awareness of his employment rights and fear of complaining. The company had not kept required hours records and did not rebut the resulting presumption of non-compliance. The Court found breaches involving breaks, weekly rest, Sunday work, maximum hours, public holidays and annual leave. It concluded Chtabbou probably worked up to 50 hours a week. The company accepted that he received no paid annual leave during more than five years of employment.
