The Labour Court found that DPMK Transport Limited breached working-time rules by failing to give former truck driver Stasys Sadauskas 24 hours’ written notice when his starting and finishing times changed. In its determination dated 29 November 2012, the Court varied the Rights Commissioner’s decision and made no further order. Sadauskas had appealed the Rights Commissioner’s decision. The Labour Court found his complaints about daily rest, breaks and average weekly hours not well founded. It found that he had received at least 11 hours’ rest between shifts, had opportunities to take breaks and had not exceeded the average weekly hours limit. The Court said the notice breach caused no loss or material inconvenience.
