Labour Court cuts Sunday premium award to €300 on Jump Juice Bars appeal

The Labour Court upheld Minika Konieczna’s Sunday-premium complaint against Jump Juice Bars Ltd, but reduced her compensation from €600 to €300. The determination was signed on 23 November 2012, after the company appealed a Rights Commissioner’s decision. The Court found that the 10% hourly premium Jump Juice Bars said it paid was not shown to compensate for Sunday work. There was no evidence it had been identified as a Sunday premium or varied according to how often Konieczna worked Sundays, so the Court concluded she had received no Sunday premium. The Court also found that the grocery-sector Employment Regulation Order relied on in the original decision had no legal effect. It considered the €600 award excessive because the Rights Commissioner had given mistaken weight to that Order, and varied the award to €300.
