The Labour Court allowed Honesto Rumbaua’s appeal against Starter Centre Limited and awarded him €1,350 for an annual leave complaint. The decision was dated 12 November 2012. The Court set aside the Rights Commissioner’s earlier finding that the complaint was not well founded. Rumbaua said he had not received his full annual leave entitlement for 2009 and 2010. The company said it had paid him for 20 days of leave in each year. The Court considered the period from 1 April to 31 December 2010 and found that the company had not supplied records to prove it complied with the law. It concluded that Rumbaua was entitled to succeed in the appeal.
