The Labour Court cut a public holiday award to Ms Eileen Mc Aleer from €3,000 to €300 after Varna Healthcare Services Limited T/A Sacred Heart Nursing Home appealed. The determination was signed on 22 October 2012.
The appeal concerned only the public holiday complaint. The Rights Commissioner’s decision on Ms Mc Aleer’s annual leave complaint was not appealed and remained unchanged. The Labour Court also refused the employer’s request to extend the time limit, finding that Ms Mc Aleer had not shown reasonable cause for the delay.
The employer said four public holiday payments had been short by €137.81 because Ms Mc Aleer was paid for 8.4 hours instead of 12. The Court accepted the employer’s calculation of the outstanding payment and varied the original decision, awarding €300 for the breaches, including compensation.
