Labour Court upholds time-barred annual-leave decision; public-holiday complaint withdrawn

By Ruairí Dolan

Labour Court ·

The Labour Court upheld the Rights Commissioner’s decision that Zbigniew Chadzynski’s annual-leave complaint was out of time, and his appeal failed; the merits were not decided. The complaint was filed five days beyond the six-month limit. The determination was signed on 11 October 2012. Chadzynski said he understood Fannin Limited’s leave year to run from January to December and learned in October 2011 that the statutory leave year ran from April to March. The Court found he had not shown reasonable cause for the delay. His separate public-holiday complaint had been withdrawn before the Rights Commissioner.
