The Labour Court upheld a €5,000 award to driver Algirdas Ketis after Masterville Limited Trading As Masterlink Logistics appealed. The determination was dated 3 September 2012.
Ketis worked as a driver from March 2006 to September 2008. He complained that the company breached working-time rules on daily rest, breaks, maximum weekly hours and notice of working hours. The employer conceded breaches involving daily rest and weekly hours, but disputed the breaks complaint.
The Court found the company kept no required records to show Ketis had taken breaks. It also found unexplained late finishing times for which the company had not shown it gave the required notice. The Court rejected the employer’s arguments that delay in the earlier decision undermined the case and that Ketis had exaggerated his claims. It considered the complaints afresh, found all four well founded and affirmed the Rights Commissioner’s decision and compensation award.
