The Labour Court upheld a €400 award to Zuzana Susienkova after her appeal for higher compensation failed. In its determination dated 22 August 2012, the Court agreed with the Rights Commissioner’s findings on her complaints against Carnegie Court Hotel under the Organisation of Working Time Act 1997. Susienkova said she missed meal breaks and did not receive the required 11-hour rest between shifts on four occasions. The hotel said she could take meals and other breaks, and accepted there were four occasions without the required rest. The Court’s investigation found there were three. It considered the €400 compensation adequate and found no reason to vary it.
