The Labour Court upheld Giedra Tiatova’s appeal and directed Michael O' Neill Mushrooms Ltd to pay €500 compensation for breaches of daily rest rules. The determination was signed on 10 July 2012. Tiatova said he was regularly required to work successive days without 11 hours’ rest and submitted attendance records. The company argued he received compensatory rest when shifts were less than 11 hours apart. The Court found at least 10 occasions without the required rest, including at least eight during the relevant time, and said the company had not shown equivalent rest was provided.
