The Labour Court reduced Anna Bielak’s €600 award to €102 after allowing an appeal by Smart Jimoh Ewanshiha T/A Progressive Services. The determination was dated 14 July 2011. The Court found that holiday pay for leave Bielak took in July 2009 had been paid, but €102 remained due when her employment ended in February 2010. The employer had not kept the required records, so it had to prove that it had paid her entitlements. A copy of a €633 cheque endorsed by Bielak supported the employer’s account of the July 2009 payment.
