The Labour Court dismissed Dovile Vaivadaite’s appeal and upheld the Rights Commissioner’s €600 compensation award against FS Sub Holdings Ltd., in a determination signed on 1 July 2011. Vaivadaite had appealed the amount awarded over complaints about breaks during long shifts and underpaid annual leave in 2009. The employer disputed that she worked until 10pm and said she received the required breaks. The Court found that she had received the breaks to which she was entitled, but had not been paid her full statutory leave entitlement for 2009.
