The Labour Court reduced the €7,500 award against Tithe Saoire Chleire Teo to €3,000 on the employer’s appeal over John Leonard’s annual leave. The determination was dated 30 May 2011. The Court found Leonard qualified for four weeks’ paid annual leave and that there was no evidence he received it in the relevant leave year. The employer said Leonard’s two weeks off in each roster included annual leave. The Court could not decide whether there had been a breach for the period from 1 April to 16 September 2009 because that leave year had not ended when the claim was made. It varied the Rights Commissioner’s decision and ordered payment of €3,000, including an element of compensation.
