The Labour Court refused Mayo General Hospital an extension of the time limit in its appeal against a €5,000 award to Peter Mc Hugh. The determination was dated 23 May 2011. The substantive appeal was not decided.
Mc Hugh, a night shift clerical officer at the hospital’s accident and emergency reception, said he regularly could not take breaks because of department demands and a lack of cover. The hospital argued it was exempt from the statutory break requirement and that compensatory rest applied. The Court found the reasons given for the delay neither explained nor excused it, limiting the period that could be considered to 21 May through 20 November 2009.
