The Labour Court varied a €1,000 award to Marek Kujawowicz, determining that Thomas Joseph Nagle should pay €360 for outstanding public-holiday and annual-leave entitlements. Nagle had appealed the Rights Commissioner’s decision. The Court signed its determination on 27 April 2011. Kujawowicz had alleged excessive hours, inadequate rest periods and shortfalls in leave and public-holiday entitlements. Nagle said he paid €306 a week for 30 core hours and that Kujawowicz requested additional duties; he disputed the hours claimed and said Kujawowicz was not asked to work public holidays. The union withdrew the section 13 claim, accepting there had been no breach. The Court allowed claims only for alleged breaches from 18 September 2008 and found two public holidays and almost four days’ annual leave remained outstanding. It found no additional compensation was warranted.
