The Labour Court varied a €3,500 award to €800 on Jaroslav Sandor T/A Slovenska Restaurant’s appeal of the Rights Commissioner’s decision in favour of Duscan Lipcak. The determination was signed on 11 April 2011. Lipcak’s complaints concerned Sunday premiums, annual leave and public holidays. The Court found Sunday-premium entitlement of €505.05 and three unpaid public holidays worth €130. It also found six hours of annual leave pay worth €52 for the leave year beginning 1 April 2009; any claim for the leave year ending 31 March 2009 was out of time. The Court said missing records left Sandor unable to dispute Lipcak’s account of Sunday work and paid days off.
