The Labour Court overturned a €900 award to Monica Burke after Tony Brennan T/A Tony's Catering Services appealed a public holiday pay decision. The determination was signed on 24 October 2011. Burke told the Court she had not worked on the 3 May 2010 public holiday and had received a full day’s pay. The Court found she had received her entitlement and there was no breach of the Organisation of Working Time Act 1997. Brennan’s appeal succeeded.
