The Labour Court overturned a €500 award to Georgina Farrell after Tony Brennan T/A Tony's Catering Services appealed a public holiday pay decision. The determination was signed on 24 October 2011. Farrell did not attend the appeal hearing. The Court found there was no breach of the Organisation of Working Time Act 1997, after the employer produced evidence that Farrell had received a full day’s pay for the 3 May 2010 public holiday and had not worked that day. The Court overturned the Rights Commissioner’s findings and award; the appeal succeeded after Farrell did not attend the hearing, and the merits were not decided.
