Labour Court directs Peamount Hospital to pay O’Reilly €1,000 and recognise sleepover hours as work

The Labour Court directed Peamount Hospital to pay Antoinette O’Reilly €1,000 and comply with a Rights Commissioner decision that sleepover hours count as working time. The original determination was signed on 16 September 2011, and an addendum requiring compliance was signed on 3 October 2011.

O’Reilly had complained that Peamount Hospital had not implemented the Rights Commissioner’s decision. The Labour Court found that the decision had not been carried out and that no appeal had been brought within the time limit. It directed the hospital to pay the €1,000 specified in the earlier decision.

The addendum required the hospital to apply the classification of sleepover hours as working time. Peamount Hospital was represented by the HSE, while O’Reilly was represented by the Services Industrial Professional Technical Union.
